1. Introduction and general information
iVenturecard.com is provided by iVenture Card International. Payments made via iventurecard.com will be processed by iVenture Card International Pty Ltd ABN 47 148 173 719 Located at Suite 202 , 99 Alexander Street , Crows Nest NSW 2065, Australia. The terms and conditions of each iVenture card vary by destination and are governed by the local operator.
1.1 This text presents the General Contracting Conditions (hereinafter the (“General Conditions”) that will govern the online contracting procedure offered by CITY TOUR WORLDWIDE, S.L. (hereinafter “City Tour”), located in Spain. The above notwithstanding, the contract shall be executed by one or more local Operators.
1.2 The user or client (hereinafter the “User” or “Client”) is informed of these General Contracting Conditions, which were made known to the User before the start of the contracting process. The User, by clicking on the button “I have read and accept the General Conditions. Order requiring payment”, agrees to accept them fully and unreservedly, along with any specific condition that may apply.
1.3 By way of these General Conditions, the User is informed that City Tour may, at any time and without prior notice, modify the contents of these General Conditions and of any specific condition that may exist.
1.4 a) Process for executing the contract: on the website you must select the iVentureCard type desired, press “Your purchase”. A window will open where you can enter your personal and bank data. You must read and accept the General Contracting Conditions and once the steps shown are properly completed, the contracting process will be completed; b) Storage and accessibility of the electronic document: we will archive the electronic document where the contract is formalised. You may access the document, which will be sent to you if you send an e-mail to the contact address shown in the clause called: “Identification of the parties”; c) Identification and correction of errors in the data entered: our registration procedure lets you check and correct any mistakes before finalising your registration. Once the contracting process is complete, you can call the City Tour phone number on +34 934 026 900 fromMonday to Friday from 9 am to 6 pm, or send an e-mail to the contact address shown in the clause called: “Identification of the parties”, and request that any wrong information be corrected; d) Language: the Spanish version language of this contract shall be binding.
2. Identification of the parties
2.1 This contract is offered by City Tour Worldwide, S.L. with tax identification number B-66595208, located at Calle Pablo Iglesias No. 84, PC 08908, L'Hospitalet de Llobregat (Barcelona, Spain), and entered in the Barcelona Business Registry in Tome 44977, Folio 192, sheet no. 2.2 The User is the purchaser of the iVentureCard (hereinafter “Card”) for use in Dubai available on the website. Users must be 18 years of age or older and be fully capable of entering into a binding contract.
3.1 The purpose of the General Conditions is to determine the legal conditions applicable to the online sale process between City Tour and the User that allows the latter to purchase the cards offered by iVentureCard Dubai for Dubai (hereinafter “The Services”).
4. Characteristics of the tickets
4.1 Users can electronically purchase the various activities cards that City Tour makes available for the purposes of providing the services contracted. A description of each service will be provided once the desired card is selected and clicked on.
4.2 When a card is purchased, a voucher will be downloaded electronically that will allow the User to redeem it for the corresponding card to provide the services.
5. General Contracting Conditions
By purchasing this Package you agree to be bound by these terms and conditions:
5.1.Packages purchased online and selected for collection must be collected within 6 months of date of purchase.
5.2 The validity of Tickets issued on purchase of a Package may be, based on the specific Package purchased as detailed in the Guide, limited to a set number of consecutive calendar days from the date of first use of any Package Benefit and/or limited to a set Ticket quantity.
5.3) Any unused Benefits included on Unlimited and Flexi packages will expire one month from date of card issuance.
5.4.) You many not return to an Operator to obtain a Benefit a second or subsequent time;
5.5.) All sales are final. Refunds will not be provided for any unused Benefits or lost or stolen Cards
5.6) Benefits presented in this Guide may vary from time to time and as such you should confirm the availability of the Benefit with the Operator prior to use of the Card.
5.7)To the extent permitted by law, iVenture disclaims all liability arising out of or consequent to your use of the Card, Guide and Benefits
5.8) All responsibility for the conduct, quality, availability or other thing in respect of the use of any Benefit is solely borne by the relevant Operator.
5.9) iVenture limits our liability or warranties implied by statute or otherwise by resupplying the relevant services.
5.10) All intellectual property rights used or embodied in or in connection with the Card, Guide or any related material is owned or licensed by iVenture
6. Price and availability
6.1 The voucher show the final full price thereof and detail any taxes and any other additional expenses that may be applicable.
6.2 We make every effort to offer precise and complete information on the service. The iVentureCard online store features the most up-to-date information possible.
6.3 City Tour may change the card prices as it deems necessary. As a result, the User, when accessing websites showing the prices of the iVenture cards, must make sure that these are the most recent websites and not an older version stored in the browser's cache. It is for this reason that when viewing the cards prices, the User agrees to click on the "Update" icon. If not, City Tour shall not be liable for any discrepancies between the ticket price shown and the latest price, the latter of which shall be applied.
7.1 When an order and payment are made, the User is assumed to consent to the offer made by City Tour and the contract shall be deemed finalised.
7.2 Once the User clicks on the “I have read and accept the general conditions. Order requiring payment” button, the order shall be binding upon the User. City Tour will email to the User within the next twenty-four (24) hours a confirmation of the order, informing the User that the order is being processed and containing the details of the contract entered into.

8. Payment method
8.1 The payment methods accepted are via credit card (Visa and Master Card).
8.2 Until the User pays the price of the tickets in full, City Tour shall retain ownership of the cards involved in the order pending payment.

9. Contract execution and duration
9.1 Once the purchase is made and paid in full, the User may enjoy the Services contracted.
9.2 This contract shall remain in effect for as long as both parties have commitments to fulfil under said contract.
10.1 City Tour is an independent intermediary between the end user and the Operators. In the event of a problem the User must contact City Tour so that it may take the appropriate actions.
11. Right to cancel
11.1 Since the service pertains to a service involving leisure activities, the User does not have the right to cancel the contract.
11.2 The purchases are not refundable under any conditions, including lack of use, theft or loss.
12.1 City Tour shall make complaint forms available to Users. If you need to use one, you can send a request to the following email address: [email protected] You can also write to this address to file any complaints, or write directly to the Customer Service Department address shown in these General Conditions.
13. Data Protection
13.2 City Tour complies with all the requirements specified by the applicable law in the area of personal data protection. All of the data in our custody are processed in compliance with legal requirements and rely on both technical and organisational measures to ensure their confidentiality.
13.3 You agree that all the information and data you give to City Tour will be real and factual.
13.4 We inform you, and you (the User) expressly agree, that the personal data you provide to us and those data resulting from your relationship with us will be included in a file or files controlled by City Tour for the following purposes:
(i) To enable the maintenance, compliance, conduct, control and management of your purchase and to provide the services contracted.
(Ii) Advertising: unless you indicate otherwise by checking the box stating your desire not to receive advertising when providing us with your data, we will interpret this as authorising us to send you marketing messages to inform you of services, sightseeing packages and other products or promotions involving leisure activities offered by us or other parties. We may send you this information by any means, including e-mail and the like, for which purpose you authorise us to retain your data during and after our business relationship.
(iii) If a User gives us the personal information of a third party, or does so in the future, the User agrees to have informed said party and to have received their consent pursuant to the conditions presented herein.
13.5 Forwarding of data:
Your data may be processed and/or provided to third parties in compliance with legal and/or contractual obligations that may apply. For example, for the purposes explained and in order to render the Services, those data that may supplied to the operator in Dubai (, the name and address of which is: iVenture LLC The Metropolis Tower – Business Bas – office 701 Dubai (UAE). To this end, Users providing their data expressly acknowledge that their data may be forwarded to this company and from this company to City Tour if required, for example, to resolve complaints or incidents related to the Service.
During the contract procedure you will be asked for your credit card information, which will be reported to the financial institution that handles the payment. This request will be made for the main purpose of validating the card, and is in keeping with the free and legitimate acceptance of the legal relationship between the User and City Tour, the development, compliance and control of which necessarily imply verification of these data against third-party files, as required in order to comply with the specified purposes.
13.6 You can exercise your rights to access, correct, delete or oppose the processing of your data by writing to City Tour, located at Calle Pablo Iglesias, n.º 84, C. P. 08908, L’Hospitalet de Llobregat (Barcelona, Spain), or by sending an e-mail to City Tour ([email protected] ), attaching a copy of an official ID document and indicating on the envelope or subject line, as applicable, Contracting Conditions or Data Protection.
13.7 Pursuant to the foregoing, it is assumed that if you provide us with your information, you expressly authorise us to process it as described above.
14. Intellectual and Industrial Property Rights
14.1 All intellectual and industrial property rights used or incorporated in relation to the Service are the property of or licensed to City Tour or the Operators.
14.2 The tickets may not be reproduced, edited or altered.
15. Liability Disclaimer
15.1 City Tour disclaims all liability that may arise from the improper use by internet users of its website and the online purchasing process.
15.2 It also disclaims all liability for any potential harm caused by third parties and that are not attributable to City Tour.
15.3 City Tour shall not be liable for any interruptions, delays, errors or malfunctions in the services, or in general for any other inconveniences that are caused for reasons beyond the control of City Tour and/or that are due to the user's malice or negligence, and/or that result from force majeure or acts of God.
15.4 Any links or hyperlinks shown that are external to City Tour are for information purposes only and are beyond the control of City Tour, which shall not be liable for the information contained therein.
16. Contract validity
16.1 If any of the clauses in these General Conditions is deemed void or inapplicable, this shall not affect the remaining clauses, which shall remain valid.
17. Applicable Legislation and Jurisdiction
17.1 In those cases where the law allows the parties to submit to a jurisdiction, both parties do expressly renounce any other jurisdiction to which they may be entitled and agree to submit to the Courts of the city of Barcelona (Spain). If the regulation provides for selecting the applicable laws, both parties shall expressly renounce any other jurisdictions to which they may be entitled and subject themselves to Spanish law.
Dubai Summer Surprises Terms and Conditions
These terms and conditions of purchase are presented by iVenture Card Dubai, the operator of iVenture Card packages. Upon purchase of this package (Package), a card (Card), designated by a display of the iVenture logo, will be electronically loaded with tickets, coupons, points or a pass (Tickets) which may enable the Card holder to obtain certain benefits (Benefits) when the Card is presented to the attractions, restaurants or other operators (Operators) as detailed in the guide (Guide). By purchasing this Package you agree to be bound by these terms and conditions: i) Packages selected for collection must be collected within 3 months of date of purchase; ii) The validity of Tickets issued on purchase of a Package may be, based on the specific Package purchased as detailed in the Guide, limited to a set number of consecutive calendar days from the date of first use of any Package Benefit and/or limited to a set Ticket quantity which expire in 7 days from first use; iii) Any unused Benefits included on the Summer Surprises Pass Unlimited and Flexi packages will expire by 31 August 2017; iv) You many not return to an Operator to obtain a Benefit a second or subsequent time; v) All sales are final.
