Payments made via iventurecard.com will be processed by iVenture Card International Pty Ltd, ABN 47 148 173 719, Level 14, 275 Alfred Street, North Sydney NSW 2060, Australia. We take payment security seriously and as such orders are subject to manual review. Upon purchase you will receive a payment receipt, please allow up to 48 hours for the manual review process to be completed, once approved your voucher will be sent via email. The terms and conditions of each iVenture card vary by destination and are governed by the local operator. |
| 1.1 | The text below contains the general contracting conditions (hereinafter the "General Conditions") that govern the online contracting procedure, in which the party responsible for the contract offered is iVenture Spain, S.L. (hereinafter "iVenture Spain"), located in Spain. The above notwithstanding, the various Operators defined later shall be responsible for providing the services contracted. |
| 1.2 | The user (hereinafter the "User") is informed of these General Contracting Conditions, which were made known to the User before the start of the contracting process. The User, by clicking on the "I have read and accept the General Conditions. Order requiring payment" button, agrees to accept them fully and unreservedly, along with any specific condition that may apply. |
| 1.3 | By way of these General Conditions, the User is informed that iVenture Spain may, at any time and without prior notice, modify the contents of these General Conditions and of any specific condition that may exist. |
| 2. | Identification of the parties |
| 2.1 | This contract is offered by iVenture Spain, S.L., with tax identification number B-59395467, located at Calle Pablo Iglesias No. 84, PC 08908, L'Hospitalet de Llobregat (Barcelona, Spain), and entered in the Barcelona Business Registry in Tome 25384, Folio 7, sheet no. | 2.2 | The User is the purchaser of the cards (hereinafter the "cards") available on the website. Users must be 18 years of age or older and be fully capable of entering into a binding contract. |
| 3. | Purpose |
| 3.1 | The purpose of the General Conditions is to determine the legal conditions applicable to the online sale process between iVenture Spain and the User that allows the latter to purchase the services offered by iVenture Spain. |
| 4. | Characteristics of the iVenture Cards |
| 4.1 | In the iVenture Spain online store, the User can purchase several types of cards that will allow access to various tourist attractions. A description of each card is available by selecting it and clicking on it. |
| 4.2 | By purchasing any of the cards, a voucher (hereinafter the "Voucher") will be electronically downloaded featuring the iVenture logo that must be redeemed at the designated points for an iVenture Barcelona card (hereinafter the "Card"), which will contain the passes (hereinafter the "Tickets") that will allow the holder of the Card to gain access to the attractions listed on the Card that was purchased when said card is presented to the operators of said attractions (hereinafter the "Operators"), as detailed in the brochure (hereinafter the "Brochure"). The "Operation of the iVenture Card" section on the iVenture Spain website contains information on the process for purchasing and collecting the physical iVenture Card. |
| 4.3 | The descriptions contained in the Brochure for the activities offered through the cards are based on information provided by the various Operators, whose data are shown at the bottom of the information on the activities they provide. |
| 4.4 | Packages purchased online and selected for collection must be collected within 6 months of date of purchase. Once exchanged for the Card, the Card must be used within 7 days. |
| 5. | Price and availability of the cards |
| 5.1 | The cards show the final full price thereof and detail any taxes and any other additional expenses that may be applicable. |
| 5.2 | We make every effort to provide exact and complete information on the product. The information that iVenture Spain publishes in its online store on the various cards offered is as recent as possible. |
| 5.3 | iVenture Spain may change the prices of the cards as it deems necessary. As a result, the User, when accessing websites showing the prices of the iVenture Spain cards, must make sure that these are the most recent websites and not an older version stored in the browser's cache. It is for this reason that when viewing the card prices, the User agrees to click on the "Update" icon. If not, iVenture Spain shall not be liable for any discrepancies between the card price shown and the latest price, the latter of which shall be applied. |
| 6. | Order |
| 6.1 | When an order and payment are made, the User is assumed to consent to the offer made by iVenture Spain and the contract shall be deemed finalised. |
| 6.2 | Once the User clicks on the "I have read and accept the general conditions. Order requiring payment" button, the order shall be binding upon the User. iVenture Spain will email to the User within the next twenty-four (24) hours a confirmation of the order, informing the User that the order is being processed and containing the details of the contract entered into. |

| 7. | Payment Method |
| 7.1 | The payment methods accepted are via credit or debit card.
A payment processing fee of 1.5% is applied to purchases made by credit or debit card. This will be added to the total price of your purchase at payment. |
| 7.2 | Until the User pays the price of the cards in full, iVenture Spain shall retain ownership of the cards involved in the order pending payment. |
| 8. | Delivery of the physical Card, contract execution and duration |
| 8.1 | You can collect the physical Card associated with the card purchased at any of our collection points (hereinafter the "Collection Points") by showing your proof of purchase to the personnel at said Collection Points. The details on the Collection Points will be printed on your receipt. The physical Card will be immediately available as soon as you indicate your consent to the contract and pay the price, as specified in Clause 6 above. |
| 8.2 | This contract shall remain in effect for as long as both parties have commitments to fulfil under said contract. |
| 9. | Guarantees |
| 9.1 | iVenture Spain acts as the independent intermediary between the end user and the Operators listed on the Brochure. In the event of a problem the User must contact iVenture Spain so that it may take the appropriate actions |
| 10. | Official language of the contract |
| 10.1 | The language to be used shall be Spanish. |
| 11. | Right to cancel |
| 11.1 | As this service involves recreational activities, the User does not have the right to cancel the contract, pursuant to Article 103 l) of Royal Legislative Decree 1/2007 of 16 November, which approves the Consumer and User Law. |
| 11.2 | The cards are not refundable under any conditions, including lack of use, theft or loss. |
| 12. | Complaints |
| 12.1 | iVenture Spain shall make complaint forms available to Users. If you need to use one, you can send a request to the following email address: [email protected] You can also write to said email address or directly to the Customer Service Department listed in these General Conditions to file a claim. |
| 13. | Data Protection |
| 13.1 | The information provided below by iVenture Spain is intended to inform you of the privacy policy that is applicable to your personal information pursuant to these General Conditions. |
| 13.2 | iVenture Spain complies with all the requirements specified by the applicable law in the area of personal data protection. All of the data in our custody are processed in compliance with legal requirements and rely on both technical and organisational measures to ensure their confidentiality. |
| 13.3 | The user agrees to provide iVenture Spain with factual and truthful information. |
| 13.4 | We inform you, and you (the User) expressly agree, that the personal data you provide to us and those data resulting from your relationship with us will be included in a file or files controlled by iVenture Spain for the following purposes:
(i) To enable the maintenance, compliance, conduct, control and management of your purchase. (ii) Advertising: during and after our relationship, you may be sent marketing communications to notify you of new cards or other products and promotions from us or from other parties, like the Julià Group, involving entertainment, artistic, leisure and recreational activities, attractions, theme parks, shows, events, concerts, plays, museums, recreational activities, tourism and tourist activities, entertainment, trips, hotels, ground passenger transport and professional rental vehicles. (iii) If a User gives us the personal information of a third party, or does so in the future, the User agrees to have informed said party and to have received their consent pursuant to the conditions presented herein. |
| 13.5 | Forwarding of data: your data may be processed and/or provided to third parties in compliance with legal or contractual obligations that may apply. For example, if needed for iVenture operations, those data that may be required may be exchanged between the distributors and attractions and iVenture Spain.
The technical services as well as some of the services located on the iVenture Spain website that, when requested by you, lead to an iVenture website, are provided by the company iVenture Card Hong Kong Travel Limited, with address at Suite 1106-8 11/F Tai Yau Building No. 181 Johnston St Wanchai Hong Kong, a country whose level of protection is not comparable to that of Europe, meaning that the User, when providing their data, expressly accepts that said data may be transferred to this company. The operation of the website may also rely on the provider called: iVenture Card Hong Kong Travel Limited, with address at Suite 1106-8 11/F Tai Yau Building No. 181 Johnston St Wanchai Hong Kong, a country whose level of protection is not comparable to that of Europe, meaning that the User, when providing their data, also expressly accepts that said data may be transferred to this company. |
| 13.6 | You can exercise your rights to access, correct, delete or oppose the processing of your data by writing to iVenture Spain, S.L., located at Calle Pablo Iglesias, nº 84, CP 08908, L'Hospitalet de Llobregat (Barcelona, Spain), or by sending an e-mail to iVenture Spain ([email protected] ), attaching a copy of an official ID document and indicating on the envelope or subject line, as applicable: Contracting Conditions Data Protection. |
| 13.7 | Pursuant to the foregoing, it is assumed that if you provide us with your information, you expressly authorise us to process it as described above. |
| 14. | Intellectual and Industrial Property Rights |
| 14.1 | All intellectual and industrial property rights used or incorporated in relation to the Card, Brochure or any material associated with them are the property of or licensed to iVenture Spain or the Operators. |
| 14.2 | The Cards may not be reproduced, edited or altered. |
| 15. | Liability Disclaimer |
| 15.1 | iVenture Spain disclaims all liability that may arise from the improper use by internet users of its website and the online purchasing process. |
| 15.2 | It also disclaims all liability for any potential harm caused by third parties and that are not attributable to iVenture Spain. |
| 15.3 | iVenture Spain shall not be liable for any interruptions, delays, errors or malfunctions in the services, or in general for any other inconveniences that are caused for reasons beyond the control of iVenture Spain and/or that are due to the user's malice or negligence, and/or that result from force majeure or acts of God. |
| 15.4 | Any links or hyperlinks shown that are external to iVenture Spain are for information purposes only and are beyond the control of iVenture Spain, which shall not be liable for the information contained therein. |
| 16. | Contract validity |
| 16.1 | If any of the clauses in these General Conditions is deemed void or inapplicable, this shall not affect the remaining clauses, which shall remain valid. |
| 17. | Applicable Legislation and Jurisdiction |
| 17.1 | These General Conditions shall be governed by Spanish law. In those cases where the law allows the parties to submit to a jurisdiction, both parties do expressly renounce any other jurisdiction to which they may be entitled and agree to submit to the Courts of the city of Barcelona (Spain). |
